A Adequação das Políticas Econômicas Brasileiras à Lei de Responsabilidade Fiscal

Resumo

O presente artigo examina a compatibilidade das políticas econômicas adotadas no Brasil com os parâmetros normativos estabelecidos pela Lei de Responsabilidade Fiscal, considerando os limites jurídicos impostos à atuação financeira do Estado e as sucessivas flexibilizações promovidas ao longo das últimas décadas. A investigação parte da compreensão de que a LRF consolidou um modelo de gestão orientado pela previsibilidade orçamentária, pelo equilíbrio fiscal e pelo controle do gasto público, atribuindo densidade jurídica à responsabilidade na condução das contas estatais. O objetivo central consiste em analisar de que forma alterações legislativas, interpretações institucionais e práticas político-orçamentárias têm reduzido a eficácia vinculante desse regime normativo. Para tanto, adota-se metodologia qualitativa, de natureza explicativa e teórico-documental, desenvolvida a partir da análise da Constituição Federal, da Lei de Responsabilidade Fiscal, da Lei de Diretrizes Orçamentárias e da Lei Orçamentária Anual, em diálogo com referenciais da teoria econômica clássica e da literatura jurídico-financeira. Os resultados indicam que a recorrente flexibilização das metas fiscais, associada à relativização do conceito de crime de responsabilidade e à ampliação de mecanismos excepcionais de gestão orçamentária, contribuiu para o enfraquecimento dos instrumentos de controle fiscal originalmente concebidos pela LRF. Conclui-se que a flexibilização reiterada de metas fiscais e a reinterpretação do conceito de crime de responsabilidade têm permitido manobras orçamentárias que esvaziam a força vinculante da LRF, revelando um processo de subordinação da legalidade fiscal a interesses conjunturais do Executivo, comprometendo a estabilidade normativa e a coerência institucional do sistema de responsabilidade fiscal brasileiro.

Abstract

This article examines the compatibility of economic policies adopted in Brazil with the normative parameters established by the Fiscal Responsibility Law, considering the legal limits imposed on the State's financial actions and the successive flexibilities promoted over the last few decades. The investigation starts from the understanding that the Fiscal Responsibility Law consolidated a management model oriented towards budgetary predictability, fiscal balance, and control of public spending, attributing legal weight to responsibility in the management of state accounts. The central objective is to analyze how legislative changes, institutional interpretations, and political-budgetary practices have reduced the binding effectiveness of this normative regime. To this end, a qualitative methodology of an explanatory and theoretical-documentary nature is adopted, developed from the analysis of the Federal Constitution, the Fiscal Responsibility Law, the Budget Guidelines Law, and the Annual Budget Law, in dialogue with references from classical economic theory and legal-financial literature. The results indicate that the recurring relaxation of fiscal targets, coupled with the relativization of the concept of malfeasance and the expansion of exceptional budget management mechanisms, has contributed to the weakening of the fiscal control instruments originally conceived by the Fiscal Responsibility Law (LRF). It is concluded that the repeated relaxation of fiscal targets and the reinterpretation of the concept of malfeasance have allowed budgetary maneuvers that undermine the binding force of the LRF, revealing a process of subordinating fiscal legality to the short-term interests of the Executive branch, compromising the normative stability and institutional coherence of the Brazilian fiscal responsibility system.
